Effective Date: Jun 27, 2025
Introduction
Polarity Parking, Inc. (referred to as "Polarity," "we," "us," or "our") is committed to protecting the privacy of our users ("you" or "your"). This Privacy Policy explains the types of personal information we collect, how we use and share that information, and the steps we take to safeguard it. By using the Polarity website or any related services (collectively, the "Service"), you agree to the terms of this Privacy Policy. If you do not agree, please do not use our Service.
Information We Collect
We may collect the following categories of information:
- Personal Information You Provide: When you create an account, register a vehicle for a parking permit, make a payment, or contact us through our Service, we collect personal information such as your name, email address, phone number, mailing address, and any other information you choose to provide. This may include vehicle details (e.g. license plate number, vehicle make/model) submitted for parking permits. If payments are processed, we (or our payment processor) may collect billing information such as credit/debit card numbers and billing addresses.
- Third-Party Payment Data: We use third-party payment processors (for example, Stripe) to handle transactions. These providers will collect and store your payment card information on our behalf . Such third-party services are contractually obligated to protect your information and use it only for the purposes of processing payments.
- Automatic Usage Data: When you access our website or app, we automatically collect certain information about your device and usage of the Service. This includes your IP address, browser type, device identifiers (e.g. MAC address), operating system, referring URLs, pages viewed, dates/times of visits, and other browsing information . We also collect log information and actions taken within the Service (such as clicks, features used, and time spent) to understand usage patterns.
- Cookies and Similar Technologies: We use cookies, web beacons, pixel tags, and similar tracking technologies to enhance your experience. Cookies are small files stored on your device that allow us to remember your preferences, recognize repeat visits, and collect additional usage data. For example, we may utilize cookies and analytics tools (such as Google Analytics) to learn how visitors use our Service. Google Analytics may collect information like your IP address through cookies; you can opt out by disabling cookies or using Google's opt-out mechanisms. These technologies help us analyze traffic, customize content, and improve our website functionality.
How We Use Your Information
We use the collected information for various legitimate business purposes, including:
- Providing and Improving Services: To operate and maintain the Service, process parking permit registrations and payments, and provide the features and functionality you request. This includes issuing digital permits, monitoring parking sessions, and notifying relevant parties (e.g. property managers or towing partners) when action is needed.
- Communication: To communicate with you about your account, transactions, or use of the Service. For example, we may send confirmations, receipts, technical notices, updates, security alerts, and support or administrative messages. We may also send newsletters or promotional communications about new features or services, but you can opt out of marketing emails as described below.
- Compliance and Safety: To comply with legal and regulatory requirements and enforce our policies and terms. We may use information to preserve and enforce our legal rights, prevent fraud or other illegal activities, protect the safety, security, and integrity of our system, users, and third parties, and address misuse of the Service.
- Analytics and Development: To conduct research and analytics on how users interact with our Service in order to improve our offerings and user experience. This includes analyzing usage trends, debugging issues, and developing new features or services.
- Facilitating Transactions: To process payments for parking fees or subscriptions and to fulfill issuance of parking permits and related services. For example, we use your information to validate parking sessions and alert property managers or enforcement personnel when a parking session expires (as part of our automated enforcement feature).
- Other Purposes with Consent: We may use your information for any other purpose that you specifically consent to or authorize, to the extent permitted by law.
Disclosure of Information
We do not sell your personal information to third parties for profit. However, we may share your information with third parties under the following circumstances:
- Service Providers: We share information with third-party service providers who perform services on our behalf. This includes payment processors, hosting and cloud services, email/SMS delivery services, analytics providers, and customer support tools. These providers are given access only to the information necessary to perform their functions and are contractually obligated to maintain confidentiality and security of your data.
- Business Partners & Property Management: If you are using Polarity as a resident or guest of a particular property, we may share relevant information with that property’s management or ownership (our business customer) to validate parking permits and manage parking enforcement. For example, vehicle and permit information may be accessible to property managers and authorized parking enforcement personnel (such as towing companies) to verify compliance and take appropriate action.
- Affiliates: We may share your information with our corporate affiliates (entities under common ownership or control with Polarity) for purposes consistent with this Privacy Policy, such as internal administration or offering related services.
- Business Transfers: In the event Polarity is involved in a merger, acquisition, bankruptcy, asset sale, or other business reorganization, your information may be transferred as part of that transaction. We would ensure any successor entity honors the commitments in this Privacy Policy regarding your personal information.
- Legal Compliance: We may disclose information as required to comply with applicable laws, regulations, legal processes, or governmental requests. This includes sharing data with law enforcement, courts, or regulators if we believe disclosure is necessary to (a) meet legal obligations, (b) protect our rights or property or the rights, property, or safety of our users or others, (c) investigate or prevent fraud or other unlawful activity, or (d) enforce our Terms of Service or other agreements.
- With Your Consent: We will share your personal information with other third parties for purposes not covered by this Privacy Policy only with your explicit consent or at your direction. For instance, if you opt-in to a co-marketing program, we may share contact information with that partner as agreed by you.
We limit any sharing of personal information to what is relevant for the intended purpose and, where applicable, will take steps to pseudonymize or aggregate data to further protect your privacy. Any sharing of your data will be for one or more of the purposes described above (such as effectively communicating with you, processing your requests, enforcing our rights, etc.).
Security
We take reasonable measures to protect the confidentiality, integrity, and security of your personal information 28 . This includes using industry-standard technical and organizational security practices such as encryption, secure servers, and access controls to safeguard data against unauthorized access or disclosure. However, please be aware that no method of transmission over the Internet or electronic storage is completely secure. While we strive to protect your information, we cannot guarantee its absolute security. You share and transmit data at your own risk. If we learn of a data breach that compromises your personal information, we will notify you and applicable authorities as required by law.
Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy or as required by law. For example, we may keep your account information and collected data active while your account remains in use or as needed to provide you services. If you delete your account or if it becomes inactive, we will archive or delete your personal information in accordance with our retention policies, unless we are required to keep it longer for legal, tax, or regulatory reasons. When personal information is no longer needed, we will securely destroy or anonymize it.
Your Choices and Rights
- Access and Correction: You have the right to access and update certain personal information you have provided to us. If you have an account, you can review and edit your profile information by logging into your account. You may also contact us to request access to or correction of other personal data that you believe we hold about you.
- Data Deletion: You may request that we delete personal information we have collected from you by contacting us (subject to certain exceptions under law). Upon verified request, we will delete or de-identify your information unless retention is required for legitimate business or legal purposes. Please note that if your account or information was provided to us by a third-party client (such as an apartment community using Polarity), we may refer your request to that third party, as they may control the data in such cases.
- Opt-Out of Marketing: If you receive marketing emails from us, you can opt out at any time by clicking the "unsubscribe" link in those emails or by contacting us directly. Even if you opt out of marketing, we may still send you transactional or service-related communications (such as payment receipts or account notifications).
- Cookies and Tracking Choices: You can control or block cookies through your browser settings and other tools. You may also remove cookies from your device at any time. However, disabling cookies may affect the functionality of our Service (for example, some features may not work properly). Some browsers have "Do-Not-Track" (DNT) features; currently, our Service does not respond to DNT signals, due to lack of an industry standard for compliance. We may allow certain third parties (such as analytics or advertising partners) to collect information about your online activities over time and across different websites when you use our Service. To learn more about interest-based advertising and to opt out of certain third-party ad tracking, you can visit the Network Advertising Initiative (NAI) or Digital Advertising Alliance (DAA) websites for opt-out information. Please note that opting out of targeted ads does not completely stop all data collection; you may still see non-personalized ads and we may still collect data for other purposes like analytics and internal operations.
- If you have any other privacy-related requests or questions (such as requesting restriction of processing or data portability), please contact us using the contact information below. We will consider and respond to all legitimate requests in accordance with applicable law.
Third-Party Links and Services
Our website or app may contain links to external websites, services, or content that are not operated by Polarity. For example, we might link to a property management site, a towing service partner, or social media platforms. This Privacy Policy does not apply to those third-party sites or services, and we are not responsible for the content, privacy practices, or policies of any third parties. We encourage you to review the privacy policies of any third-party website or service that you visit or use through our Service.
Children’s Privacy
Our Service is not directed to children under the age of 13, and we do not knowingly collect personal information from anyone under 13 years old. If you are under 13, please do not use this Service or provide any personal information. In the event we learn that we have inadvertently collected personal data from a child under 13, we will promptly delete that information from our records. If you are a parent or guardian and you believe a child under 13 has provided us with personal information, please contact us so we can take appropriate action.
If applicable: For teens between 13 and 18, we advise that you use the Service only with parental consent and supervision, and that the parent/guardian review this policy.
Changes to this Privacy Policy
We may update or modify this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. Any changes will be effective when posted. When we update the policy, we will revise the "Effective Date" at the top. In the case of significant changes, we may provide a more prominent notice (such as on our website or via email notification). We encourage you to review this Policy periodically to stay informed about how we are protecting your information. Your continued use of the Service after any changes to this Privacy Policy constitutes your acceptance of the updated terms.
