Polarity Parking, Inc. Privacy Policy
Effective Date: Oct 14, 2025
Introduction
Polarity Parking, Inc. (referred to as "Polarity," "we," "us," or "our") is strongly committed to respecting and protecting your privacy. This Privacy Policy (“Policy”) explains the types of personal information we collect, how we collect, use, and share that information, and the steps we take to safeguard it. It applies to information collected through Polarity’s websites, mobile applications, and related parking services (collectively, the “Services”). By using the Services or otherwise providing us with personal data, you agree to the terms of this Privacy Policy and consent to the collection, use, and disclosure of your information as described herein. If you do not agree, please do not use our Services.
For purposes of this Policy, “Personal Data” (or “Personal Information”) means any information that identifies, relates to, describes, or can reasonably be linked to an individual. Personal Data does not include publicly available information from government records, deidentified or aggregated information, or other information excluded from the scope of applicable data privacy laws. Because some of the concepts in this Policy are technical or legal, we have endeavored to explain them as clearly as possible. If you have any questions about our privacy practices, please contact us using the information at the end of this Policy.
Information We Collect
We collect information from and about users of our Services in a few different ways. The categories of information we collect include:
- Personal Information You Provide – You may provide certain Personal Data directly to us when you interact with the Services. For example, when you create an account, register a vehicle for a parking permit, make a parking reservation or payment, fill out a form, or contact us for support, we collect information such as your name, email address, phone number, mailing address, and any other information you choose to provide. This may include vehicle details (e.g. license plate number, vehicle make/model) submitted for parking permits or registrations. If payments are processed, we (or our third-party payment processor) may collect billing information such as credit or debit card numbers and billing addresses for transaction purposes. We will also collect any other Personal Data you voluntarily provide to us (for instance, if you enter a promotion, respond to a survey, or communicate with us by email or through the app).
- Information from Third Parties – We may receive Personal Data about you from other sources. For example, if you are using our Services as a guest or resident at a property managed by one of our business clients, that property’s management may provide us with information about you (such as your name, unit number, vehicle information, or contact details) to facilitate parking access and enforcement. Similarly, a friend, family member, or employer might give us your information – for instance, someone may register your vehicle as a permitted guest in our system or an employer could provide details to set up a corporate parking account. In addition, we use third-party payment processors (e.g. Stripe) to handle transactions, so your payment card information may be collected and stored on our behalf by those providers. Such third parties are contractually obligated to protect your information and use it only for the services they perform (for example, processing a payment). We may also receive information from identity verification services or analytics providers to supplement or verify the data we hold.
- Information Collected Automatically – Like many online services, we automatically collect certain information about your device and your use of our Services, to help us operate and improve our platform. This includes:
- Usage and Interaction Data: Information about your activity on the Services, such as the pages or screens you view, features you use, links and buttons you click, the date and time of your visits, and the amount of time spent on each part of our Services. For example, we may log that you viewed a particular parking location or navigated to a certain section of our app, or record when you start and stop a parking session. This data helps us understand usage patterns and preferences.
- Device Identifiers and Technical Data: We collect identifiers and technical information about the device and software you use to access the Services. This may include your Internet Protocol (IP) address and general location inferred from it, your device’s unique IDs (such as MAC address or mobile advertising ID), device type and model, browser type, operating system and version, network provider, and similar information. We also record standard server log information such as error logs, and the website or app that referred you to our Site (for instance, if you followed a link from a different website).
- Geolocation Data: With your permission, we may collect precise geolocation data from your mobile device or browser. For example, if you use our mobile app and allow location services, we may gather your device’s precise GPS location to show nearby parking options or to verify that you are at a specific property for parking enforcement purposes. You can control this location access in your device settings. If you do not enable location services, we may still infer location at a coarse level (e.g., city or ZIP code) from your IP address or the parking facility you select.
- Cookies and Similar Technologies: We and our partners use cookies, web beacons, pixels, and other tracking technologies to automatically collect information about your interactions with our Services. Cookies are small text files placed on your device that allow us to remember your preferences and recognize you on repeat visits. Web beacons (also known as clear GIFs or pixel tags) are tiny images or snippets of code embedded in a website or email that can track things like whether you opened an email or viewed a particular web page. We (or third-party analytics and advertising partners) may use these technologies to collect information about your device and browsing actions over time and across different websites or apps. This helps us facilitate logins, personalize content, analyze traffic, and improve our Services. (See Cookies and Tracking Technologies below for more details on how we use these tools and how you can manage your choices.)
We collect the categories of data described above for the purposes described in the next section, and as otherwise disclosed to you at the time of collection or with your consent. If you choose not to provide certain Personal Data (such as account or payment information), you may not be able to use or access some of our Services.
How We Use Your Information
We use the information we collect for a variety of legitimate business and operational purposes in order to operate effectively and provide you with the best possible parking experience. Specifically, we may use your information in the following ways:
- Providing and Improving Services: To operate, maintain, and provide you with the features and functionality of our Services, and to fulfill your requests. This includes processing parking permit registrations and reservations, facilitating payments, and enabling you to access parking facilities or digital permits you have requested. For example, we use your information to issue parking permits, validate your parking credentials, monitor active parking sessions, and provide real-time parking availability or alerts. We also use collected information to understand and improve the performance of our Services – for instance, fixing bugs, refining the user interface, and ensuring the Service works properly on different devices and browsers.
- Customer Support and Communications: To communicate with you about your account and use of the Service, and to provide customer support. This includes sending transaction confirmations, receipts, parking session updates, technical notices, security alerts, and administrative messages. We may also contact you in response to your inquiries or to inform you of important changes to the Services (for example, if a parking facility’s rules change or if our terms are updated). Additionally, we use your information to respond to any questions, requests, or issues you raise; to troubleshoot problems you encounter; and to ensure we provide effective and timely customer service. Our support team may reach out via email, phone, in-app messages, or other channels as appropriate.
- Marketing and Promotions: To send you news and information about Polarity and our Services, such as newsletters, promotions, or special offers, in accordance with your communication preferences. For example, we might email you about new features, upcoming services, discounts on parking, or events and partnerships that we believe could interest you. We may also invite you to participate in surveys, contests, or referral programs. You can opt out of marketing emails or texts at any time, as described in the “Communication Preferences” section of this Policy. (We will not send you promotional communications if you have opted out.)
- Analytics and Development: To analyze usage trends and conduct research to improve, personalize, and develop our products and services. We examine how users interact with our website and app (e.g., which features are most popular or which pages are confusing) so we can enhance usability and quality. This includes performing data analytics, audits, and testing; measuring the effectiveness of our features or marketing campaigns; debugging and troubleshooting technical issues; and developing new tools, features, and services to better serve our users. We may also use aggregated or de-identified data to generate insights that help us optimize parking availability, improve enforcement efficiency, or inform our business strategies.
- Compliance and Safety: To enforce our terms and policies, comply with applicable legal and regulatory requirements, and ensure the safety, security, and integrity of our Services. For example, we may use your information to prevent, investigate, or address fraud, unauthorized parking, vehicle theft, or other illegal activities on our platform or at properties we service. We also use data to protect the rights, property, or safety of Polarity, our users, our clients (such as property owners), and the public. This could include using vehicle and contact information to notify authorities or towing services in cases of policy violations, or retaining records as required by law enforcement inquiries. Additionally, we may use your information to exercise or defend legal claims, conduct audits and compliance checks, and generally fulfill our legal obligations.
- Facilitating Parking Transactions and Enforcement: To process payments and complete parking transactions, as well as to enable parking enforcement features in collaboration with property managers and enforcement partners. For instance, we use your payment information to charge you for parking fees or subscription services and to provide you with receipts. We also use your vehicle and permit information to validate that a vehicle is authorized to park in a given location and to alert property management or authorized enforcement personnel (such as a towing company) when a parking session has expired or an unauthorized vehicle is detected. This automated alerting is part of our effort to streamline parking enforcement while giving users real-time notifications (e.g., we might send you a warning via SMS or app notification before enforcement action is taken).
- Other Purposes With Your Consent: We may use your Personal Data for any other purpose that you specifically consent to or direct us to accomplish, to the extent permitted by law. For example, if you agree to participate in a joint marketing program with one of our partners, we will use your information for that purpose. We will make it clear at the time of collection if your information will be used for any purpose not covered by this Policy, so you can choose whether to provide it.
We will not use your Personal Data for purposes that are incompatible with those described above without notifying you and obtaining your consent, when required.
How and When We Share Your Information
We understand the importance of your privacy, and we do not sell your personal information to third parties for profit. However, we do share your information with third parties in certain situations to operate our business and provide our Services. The types of third parties with whom we may share Personal Data (and the reasons for sharing) include:
- Service Providers: We share information with trusted third-party companies that perform services on our behalf and under our instructions. These service providers assist us with various business operations, such as payment processing, cloud hosting and data storage, email and SMS delivery, analytics, customer support software, mapping services, and other IT or administrative support. For example, we may share your contact information with an email service to send account alerts, or share limited data with analytics providers to analyze usage patterns. These providers are given access only to the information necessary for them to carry out their functions, and they are contractually required to protect your data and use it only for the purposes of providing their services to Polarity.
- Property Management and Enforcement Partners: If you are using Polarity in connection with a specific property (for example, if you are a resident or guest in an apartment community, campus, or commercial property that uses Polarity for parking management), we may share relevant information with the property’s management, owners, and their designated parking enforcement partners. This sharing is integral to providing the Service at that property. For instance, we may make vehicle and permit details accessible to property managers, security personnel, or authorized towing companies so they can verify parking permits, identify unauthorized vehicles, and take appropriate action (such as issuing warnings or arranging for towing). We share only the information necessary for these partners to enforce parking rules (e.g., confirming whether a license plate is associated with a valid permit), and they are expected to handle the information in accordance with applicable privacy laws and their own privacy policies.
- Affiliates: We may share your information with our corporate affiliates – that is, any other companies that are under common ownership or control with Polarity Parking, Inc.. These affiliated entities will use your information in a manner consistent with this Privacy Policy (for example, for internal administrative purposes or to offer related services to you). If our corporate structure changes (e.g., through a reorganization or creation of subsidiaries), we may share your data within that corporate family under the same privacy commitments.
- Business Transfers: In the event Polarity is involved in a merger, acquisition, investment transaction, reorganization, sale of assets, bankruptcy, or other similar corporate event, your information may be transferred as part of that transaction. For instance, if another company acquires Polarity or all (or a portion) of our business, personal data held by Polarity may be one of the transferred assets. In such cases, we will ensure that the successor entity is bound by terms substantially consistent with this Privacy Policy regarding your Personal Data, or we will notify you and obtain your consent if required by law. We will also give you notice via the contact information we have on file or via a prominent notice on our website if your data becomes subject to a different privacy policy as a result of a business transaction.
- Legal Compliance and Protection: We may disclose your information when we believe in good faith that such disclosure is necessary to comply with a legal obligation or request, such as a subpoena, court order, or government demand. We also may share data in the course of an investigation or in response to law enforcement inquiries (for example, providing parking records or account information to law enforcement as required by law). Furthermore, if we believe disclosure is appropriate to protect our rights or property, or the rights, property, or safety of our users, clients, or others, we may share information in that context. This can include exchanging information with other companies and organizations for fraud prevention, security, or enforcement of our Terms of Service and other agreements.
- With Your Consent: Apart from the situations outlined above, we will only share your Personal Data with third parties for purposes not covered by this Privacy Policy when you have given us explicit consent to do so. For example, if you opt-in to a program or promotion in partnership with another company (such as a co-sponsored event or a discount arrangement), we might share your contact information with that specific third party, but only with your knowledge and approval. You are free to revoke your consent at any time (e.g., by opting out of a program), and we will stop any further sharing for those purposes.
We take steps to limit the information we share to what is reasonably necessary for the intended purpose. Wherever feasible, we may anonymize or aggregate data before sharing it with third parties so that it does not directly identify individuals. In all cases, any third-party with whom we share Personal Data is expected to handle it securely and lawfully.
No Selling of Personal Data: As stated above, Polarity does not sell or rent your Personal Data to unaffiliated third parties for their marketing or other independent use, and we do not share personal information with third parties for cross-context behavioral advertising (targeted advertising) without your consent. If in the future we anticipate engaging in any practices that might be considered a “sale” or “sharing” of personal data under applicable laws (for example, under California law), we will provide the required notices and opt-out mechanisms.
Where We Store Your Data
We take reasonable measures to protect the confidentiality, integrity, and security of your personal information 28 . This includes using industry-standard technical and organizational security practices such as encryption, secure servers, and access controls to safeguard data against unauthorized access or disclosure. However, please be aware that no method of transmission over the Internet or electronic storage is completely secure. While we strive to protect your information, we cannot guarantee its absolute security. You share and transmit data at your own risk. If we learn of a data breach that compromises your personal information, we will notify you and applicable authorities as required by law.
Data Retention
Polarity Parking is based in the United States, and the Personal Data we collect is primarily processed and stored on secure servers located in the U.S. We may also transfer or store your information in other countries, for example if we utilize cloud service providers or technical support teams located outside the U.S. In particular, data may be stored or processed in jurisdictions that have data protection laws which are less stringent than those of your home jurisdiction. Regardless of where your data is located, we will take appropriate measures to ensure your information is protected in accordance with this Privacy Policy. By using our Services or submitting your information, you understand and consent that your Personal Data may be transferred to and stored in the United States or other countries, and that those jurisdictions might have different privacy laws than your country of residence.
If you are accessing the Services from outside the U.S., please note that your information will be transferred to the U.S. and possibly other jurisdictions, and will be subject to the laws of those jurisdictions (including government access laws). However, our practices regarding your Personal Data will at all times continue to be governed by this Policy and any applicable agreements between you and Polarity. When we transfer Personal Data internationally, we will do so in compliance with applicable legal requirements (for instance, by using standard contractual clauses or other approved transfer mechanisms, where required).
How Long We Retain Your Data
We retain Personal Data for as long as necessary to fulfill the purposes for which it was collected, or for other legitimate business or legal purposes. In general, this means we will keep your information for: (i) the duration of your account being active or the period during which we are providing Services to you; (ii) any additional period required to comply with law, resolve disputes, enforce our agreements, or as otherwise necessary to establish, exercise, or defend our legal rights; and (iii) any retention period that is mandated by applicable laws and regulations.
For example, as long as you maintain an active account with us, we will retain the information associated with your account. If you close your account or it becomes inactive, we will either delete your Personal Data or archive it in accordance with our retention policies and schedules. Even if you request deletion of your data (see Your Privacy Rights below), we may be required to retain certain information for a period of time to comply with law or for legitimate business purposes such as auditing, accounting, or security. When Personal Data is no longer needed for any permissible purpose, we will securely erase, anonymize, or otherwise dispose of it.
In some cases, rather than delete your data, we may anonymize it so that it can no longer be associated with you and use that information for analytical purposes. Please note that backup copies of Personal Data might persist in our systems for a short period (due to routine data backup processes) before they are fully purged. We continuously evaluate our storage needs and may delete or anonymize data earlier than the above periods if we determine it is no longer necessary.
How We Secure Your Data
We recognize the importance of securing all Personal Data collected through our Services. Polarity implements reasonable and appropriate administrative, organizational, technical, and physical safeguards designed to protect your Personal Data against unauthorized access, destruction, loss, alteration, or disclosure. These security measures include, for example, industry-standard encryption protocols for data in transit, secure server infrastructures, network firewalls, and access controls that limit internal access to personal information on a need-to-know basis. We also regularly review our information collection, storage, and processing practices to prevent unauthorized access and to improve security.
Please be aware, however, that no method of transmitting information over the internet or storing data electronically is completely secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee absolute security of your data. You share information with us at your own risk, and you should also take steps to secure your own devices and accounts (such as choosing strong passwords and not sharing your account credentials).
Polarity has adopted procedures to deal with any suspected data breach involving Personal Data. In the unlikely event of a data breach, we will promptly notify affected users and the appropriate authorities as required by law. We also require our employees, contractors, and service providers to adhere to strict confidentiality and security obligations. If you believe that the security of your account or information has been compromised, please contact us immediately so we can assist.
Cookies and Tracking Technologies
How We Use Cookies and Similar Technologies: We (and our third-party partners) use various technologies to collect information about your use of our Services over time and across different platforms. These technologies include cookies, pixels, web beacons, software development kits (SDKs), and local storage objects, among others. They serve several important functions, such as helping us recognize you, remember your preferences, keep you logged in, understand how you are interacting with our Services, and personalize your experience. Below is a brief overview of these technologies:
- Cookies A cookie is a small text file that is placed on your computer or mobile device when you visit a website. We use both session cookies (which expire once you close your browser) and persistent cookies (which stay on your device until you delete them or they expire) for authentication, security, and personalization. For example, cookies allow us to remember your login credentials or parking preferences so you don’t have to re-enter them each time. Cookies also help us compile aggregate statistics about site usage and understand which features are popular. You can learn more about cookies (and how to manage or disable them) in the Your Choices section below.
- Web beacons: Web beacons (also called pixel tags or clear GIFs) are tiny transparent images or snippets of code integrated into our website or emails. They contain unique identifiers that enable us to detect when certain content is accessed or emails are opened. We use web beacons to, for example, count how many users have visited a page or opened an email newsletter, or to monitor the effectiveness of advertising or marketing campaigns. Web beacons work in conjunction with cookies – if you disable cookies, the web beacon will still record an anonymous visit but cookie information will not be associated with it.
- Mobile Identifiers and SDKs: For our mobile application, we may use mobile identifiers and SDKs which function similarly to cookies and web beacons in an app environment. A mobile SDK is a bit of code that we include in our app to enable data collection and analysis about how the app is used, or to integrate with third-party services (like analytics or push notifications). These mobile identifiers (such as Apple’s IDFA or Android’s Advertising ID) and SDK tools help us deliver notifications to your device, analyze app crashes or performance, and understand user engagement within the app. You can reset your mobile advertising identifiers or limit ad tracking in your device’s settings if you wish.
- Local Storage & Other Technologies: We may utilize other tracking technologies such as local storage objects (including HTML5 local storage and browser-based caches) and Flash cookies (also known as local shared objects) to collect and store information. These technologies can persist on your browser or device beyond your browsing session and may store preferences or usage data (e.g. volume settings for a media player on the site). They operate differently from cookies and might not be managed via standard browser settings.
Why We Use These Technologies: In summary, the data collected through cookies and similar technologies allows us to better understand our users and improve our Services. For instance, these technologies enable functionalities like saving your session so you don’t have to log in repeatedly, keeping track of your parking cart or selected location, personalizing content (such as showing you the most relevant parking options), and remembering your preferences (like language or interface settings). They also help us and our advertising/analytics partners to serve you better by measuring usage, preventing fraud, and possibly providing more relevant marketing. We do not use cookies or tracking technologies to collect sensitive personal information such as your credit card number or password.
Your Choices: Disabling Cookies: Most web browsers are set to accept cookies by default, but you have the ability to refuse or delete cookies. You can modify your browser settings to notify you when a cookie is being set, or to block cookies altogether. Please note that if you choose to disable or delete cookies, some features of our website may not function properly or your experience may be degraded. For example, if cookies are disabled, you may need to re-enter your login information each time or certain preferences might not be saved. Additionally, disabling cookies might interfere with some of the analytics and targeting efforts that rely on them. Because browser configurations vary, you should consult your browser’s help documentation for instructions on how to manage cookies. You may also have to separately disable or delete Flash cookies or other local storage, as those might not be controlled via the standard browser settings. For more information about cookies and how to manage them, resources like AllAboutCookies.org provide detailed guidance.
“Do Not Track” Signals: Some web browsers offer a “Do Not Track” (DNT) setting that allows you to signal your privacy preference not to have data about your online activities tracked across websites. At this time, our websites do not respond to “Do Not Track” signals or similar mechanisms, because there is currently no industry-wide standard or consensus on how such signals should be interpreted. We will continue to monitor developments around DNT browser technology and may re-evaluate our approach if a uniform standard emerges. In the meantime, you can use the various other opt-out methods described in this Policy to control personalized advertising and tracking (for example, browser cookie controls and the opt-out tools provided by the Digital Advertising Alliance and Network Advertising Initiative, described below).
Third-Party Analytics and Advertising: We may allow certain third-party service providers to use cookies and other tracking technologies on our Services to collect information about your online activities over time and across different websites. These third parties include, for example, analytics providers like Google Analytics (which we use to understand how users interact with our site) and advertising or retargeting networks that help us deliver or measure our marketing campaigns. The information these parties collect (such as which pages you visit, for how long, what links you click, or identifiers associated with your device) may be used to analyze and track data, determine the popularity of certain content, and deliver advertisements for our services on other websites or apps (“
For interest-based advertising, we adhere to the Self-Regulatory Principles for Online Behavioral Advertising. You can learn more about how to opt out of targeted ads delivered by members of the Network Advertising Initiative (NAI) or the Digital Advertising Alliance (DAA) by visiting their opt-out pages. Specifically, you can visit the NAI’s opt-out page or the DAA’s Consumer Choices page to opt out of receiving tailored ads from participating companies. Keep in mind that opting out of targeted advertising through these mechanisms does not mean you will no longer see any advertisements; rather, you will see ads that are generic and not based on your interests or browsing behavior. Also, the opt-out is browser-specific, so you should set it on each web browser and device you use.
Finally, please note that even if you opt out of certain cookies or interest-based advertising, we may still collect some data about your online activity for other purposes (such as analytics, research, or internal operations), and you will still encounter advertising – only it may be less relevant to your interests. For more information about online tracking and opt-out options, you may also visit websites like www.allaboutcookies.org or www.youronlinechoices.eu (if you are in the EU) for guidance.
Communication Preferences
You have choices regarding how we communicate with you. Below are the ways you can manage or opt out of certain types of communications from us:
- Promotional Emails: If you no longer wish to receive marketing or promotional emails from us, you can unsubscribe at any time by clicking the “unsubscribe” link included at the bottom of such emails. You can also opt out of marketing emails by contacting us directly and requesting removal from our mailing list. Please note that even if you opt out of promotional communications, we may still send you transactional or administrative emails related to your account or use of the Services (for example, a payment receipt, parking confirmation, password reset email, or customer service correspondence), as these are not promotional in nature. It may take a few days to process your email opt-out, during which you might still receive communications already in the pipeline.
- Text Messages (SMS): We may send you SMS/text messages for account verification, parking session updates, urgent alerts (such as a reminder that your parking session is about to expire), or marketing purposes if you have consented to receive them. You can opt out of receiving text messages from us at any time by replying STOP to any message you receive (or by following the instructions provided in the message). After you text STOP, we will send a confirmation text acknowledging your opt-out, and you should not receive further texts except for messages confirming your opt-out or in the event of an emergency or required notice. If you need help or have questions about our text message program, you can reply HELP to any of our messages or contact us at our support email/number. Message and data rates may apply to any texts we send (or that you send to us), according to your mobile plan. Message frequencies may vary depending on your interaction with the Services (for example, you might receive more texts during an active parking session or promotion, and fewer at other times). Opting out of text messages may limit your ability to receive real-time notifications (for instance, you might not get an SMS alert that your parking time is almost up), so please keep that in mind when deciding to unsubscribe.
- Push Notifications: If you use our mobile app, we may request to send you push notifications or alerts on your device. These notifications might include reminders about expiring parking sessions, important account updates, or promotional alerts. You can manage push notifications through your device’s settings – typically under the app permissions or notifications section. For example, if you do not want to receive push notifications from us, you can disable them on a per-app basis in iOS or Android settings. Please note that if you disable push notifications, you might miss out on time-sensitive alerts (such as a notification that your vehicle’s parking authorization is about to end or confirmation of a completed transaction).
If you have multiple accounts or multiple devices, you may need to adjust your preferences for each account or device. We will endeavor to comply with your opt-out requests promptly. If you continue to receive communications you have opted out of, please contact us so we can investigate the issue.
Your Privacy Rights
Depending on your jurisdiction (for example, if you are a resident of California or certain other states), you may have specific legal rights regarding your Personal Data. Polarity is committed to honoring applicable data rights and has processes in place to enable you to exercise them. These rights may include:
- Right to Know/Access: You have the right to know what personal information we have collected, used, shared, or sold about you, and to request access to that information. This includes the right to ask us for the specific pieces of Personal Data we hold about you, as well as additional details like the categories of Personal Data we have collected, the sources of that data, the purposes for collecting it, and the categories of third parties with whom we have shared or disclosed it. Provided we can verify your identity (see Exercising Your Rights below), we will provide you with this information as required by law.
- Right to Deletion: You have the right to request that we delete Personal Data that we have collected from you and retained, subject to certain exceptions. Once we receive and confirm a verifiable deletion request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. Please note that the law permits us to retain some information notwithstanding a deletion request, for example, to complete the transaction for which the information was collected, to comply with a legal obligation, to detect security incidents, to exercise free speech or another right, or for certain internal purposes such as bookkeeping. We will inform you if any such exception applies to your request.
- Right to Correction: You have the right to request that we correct any inaccurate personal information we maintain about you. If you believe that any of your information is incorrect or incomplete, please let us know. Upon verifying the validity of a correction request, we will promptly correct (or rectify) the accuracy of the Personal Data in question.
- Right to Data Portability: You have the right to obtain a copy of your personal information in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance. In practice, this means that upon request, we can provide you with an electronic copy of the information we have about you, often in a common format like CSV or JSON, so that you can easily transfer it. We will choose a format that is reasonably useful and expected to be accessible; however, we cannot guarantee that any specific format will be compatible with every system. We will not charge you for this service, unless a request is repetitive or excessive as described below.
- Right to Opt Out of Sale/Sharing: If applicable laws grant you the right to opt out of the “sale” of your personal information or the “sharing” of your personal information for targeted advertising purposes, you may exercise that right at any time. As noted above, Polarity does not currently sell personal data to third parties for monetary consideration, nor do we share personal data with third-party advertisers for cross-context behavioral advertising without consent. Therefore, in general, there is no need for you to submit a request to opt-out of sales or sharing of your data, as we do not engage in those practices. If we ever do engage in data sharing that falls under these categories, we will provide a clear method for you to opt out (such as a “Do Not Sell or Share My Personal Information” link on our website, as required by law). You may also send us an opt-out request if you just want to be certain – we will record your preference and exclude your data from any future sale or sharing should our practices change.
- Right to Limit Use of Sensitive Personal Information: In certain jurisdictions (such as California under the CPRA), you have the right to direct businesses to limit the use or disclosure of “sensitive” personal information if it is used for purposes beyond what is necessary to provide the requested services. Examples of sensitive data may include precise geolocation, financial account information, or account passwords. Polarity does not use or disclose sensitive personal data for any purposes other than those necessary to provide the Services (or other limited purposes permitted by law). For instance, we only use your payment information to process transactions you initiate, and we only use precise geolocation data (if collected) to provide location-based parking services to you. Because we do not use sensitive data to infer characteristics about you or for unrelated purposes, we currently do not offer a separate opt-out for sensitive data use. If you have any concerns about sensitive data usage, you can contact us for more information.
- Right to Opt Out of Profiling/Automated Decision-Making: Some privacy laws provide individuals with the right to opt out of being subject to decisions based solely on automated processing (i.e., without human involvement) that produce legal or similarly significant effects. Polarity generally does not make any decisions about you that are completely automated and have a significant impact on you – for example, decisions about parking enforcement actions typically involve property management or towing personnel, not just our algorithms. However, if you believe that you are being subject to an automated decision or profiling by Polarity that is unfair or inaccurate, you have the right to object to that processing. Please contact us with details of your situation, and we will review and accommodate your request to the extent required by applicable law.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights. This means, for example, that we will not deny you our Services, charge you a different price, or provide a different level or quality of service just because you exercised your rights under applicable law. In certain cases, if you request deletion of data that is necessary to provide the Service, we may not be able to continue providing you that Service – but we will inform you of such consequences when responding to your request so you can make an informed decision. In no event will we retaliate against you for exercising your rights.
Exercising Your Rights: To exercise any of the applicable privacy rights described above, please submit a request to us by contacting Polarity using one of the following methods:
- Web Form: If available, you may submit a request through our online Privacy Request form (on our website’s privacy center).
- Email: You can email your request to us at support@polarityparking.com. Please state your request clearly (e.g., “Data Access Request” or “Delete My Information”) and include your full name, the email associated with your account, and any other pertinent details.
- Telephone: You may call us toll-free at 401-402-0046 and speak to our privacy team or leave a detailed message with your request and contact information.
For your security and to prevent unauthorized access to your data, we will need to verify your identity before processing certain requests. The verification steps may vary depending on the sensitivity of the data and the type of request. For instance, we might ask you to confirm a piece of information we have on file (like the last four digits of a credit card or your vehicle’s license plate number on record). In some cases, we may use a third-party identity verification service to assist. If we cannot verify your identity, we may have to deny the request, but we will inform you if that is the case.
If you would like to designate an authorized agent (such as an attorney or someone with power of attorney) to make a request on your behalf, we will take steps to verify both you and the agent’s authority. For example, we may require a written authorization or proof of the agent’s legal authority to act for you, and we may need you to directly confirm with us that you provided the agent permission.
Once we receive a request and verify identity (when required), we will respond within the timeframe required by law. Under most U.S. state laws, we will respond to your request within 45 days. If we need more time (up to an additional 45 days, for a total of 90 days), we will notify you of the extension and the reason for the delay in writing. Our response will typically cover the 12-month period preceding the receipt of your request, or as otherwise required by law. If for some reason we cannot comply with a portion of your request, our response will explain the reason (for example, if we are prohibited by law from disclosing certain information). For data portability requests, we will provide your information in a commonly used digital format, which should allow you to transmit the data to another entity.
We do not usually charge a fee to process a request. However, if a request is manifestly unfounded or excessive (for example, repetitive requests beyond what the law permits), we may charge a reasonable fee or decline to act on the request, as allowed by law. If we determine a fee is necessary, we will tell you why and provide a cost estimate before completing your request.
If we decline to take action on your request, you have the right to appeal our decision. You may do so by contacting us again (using the contact information above) and stating that you are appealing our response. Please include the words “Data Rights Appeal” in the subject or attention line so that it reaches the correct team. We will review your appeal and respond within the time frame required by law (generally 45 days). If we ultimately deny your appeal, we will inform you of any further recourse. For residents of certain states (for example, Colorado or Connecticut), if you are not satisfied with our handling of your request or appeal, you may contact your state’s Attorney General or privacy regulator to lodge a complaint. We invite you to contact us first with any concerns, and we will do our best to address the issue amicably.
California “Shine the Light” Disclosure: California’s “Shine the Light” law (Civil Code § 1798.83) gives California residents the right to request information about what personal information we disclose to third parties for those third parties’ own direct marketing purposes in the preceding calendar year. Polarity’s policy is not to share personal information with unaffiliated third parties for their own direct marketing use without your consent. Therefore, under normal circumstances, we would have no such disclosures to report. If you are a California resident and want to make a Shine the Light request to know the categories of information that we have shared (if any) and the names of third parties to whom such information was disclosed in the last year, you may submit a request to us using the contact details in this Policy. Please include “CA Shine the Light Request” in your communication and provide sufficient contact information for us to reach you (such as your name, address, and email address). We will provide the requested information to you in accordance with California law.
Finally, if you have questions about your privacy rights or how to exercise them, you can always contact our privacy team at the contact information below. We are here to help and will respond to all legitimate requests as promptly as we can, consistent with applicable law.
Changes to this Privacy Policy
We may update or modify this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. Any changes will be effective when posted. When we update the policy, we will revise the "Effective Date" at the top. In the case of significant changes, we may provide a more prominent notice (such as on our website or via email notification). We encourage you to review this Policy periodically to stay informed about how we are protecting your information. Your continued use of the Service after any changes to this Privacy Policy constitutes your acceptance of the updated terms.
Third-Party Links and Services
Our Services may contain links to or integrations with websites, applications, and services that are operated by third parties and are not controlled by Polarity. For example, we might provide links to a property management portal, a partner’s website, a payment processor’s checkout page, or social media platforms. This Privacy Policy applies only to information collected by Polarity through our own Services, and not to any third-party websites or services. We are not responsible for the content, privacy practices, or security of other websites or services that are operated by third parties. Those third-party sites and services may have their own privacy policies, which we encourage you to review. If you access external websites or services via links from our Service, any data you provide to those external parties is not covered by this Policy.
Additionally, any inclusion of a link or integration on our Service to a third-party site does not imply that we endorse or have reviewed their practices. We provide these links for your convenience, and your use of any third-party site is at your discretion. For example, if our app integrates with a mapping service for directions, that mapping service’s use of your data (such as location) is governed by its own privacy policy, not ours. We recommend that you exercise caution and read the privacy policy of each third-party website or service that you visit or use. Polarity is not liable for any information you share with those third parties or how they collect and use your data.
Children’s Privacy
Our Services are not directed to children under the age of 13, and we do not knowingly collect personal information from individuals under 13 years old. If you are under 13, please do not use our Services or send us any personal information. In the event that we learn we have collected personal data from a child under 13 without verified parental consent, we will promptly delete that information from our records. If you are a parent or guardian and you believe that your child under 13 has provided us with information, please contact us immediately so that we can investigate and take appropriate action.
While our Services are intended for adult users in most cases (such as drivers, property managers, etc.), we recognize that teenagers might also use our apps or be registered as permit holders (for instance, a 16-year-old with a driver’s license living in an apartment complex). If you are between the ages of 13 and 18, we recommend that you use the Services only with the involvement and consent of a parent or guardian, and that you review this Privacy Policy with them. We do not knowingly allow minors under 18 to create accounts without parental consent, and we reserve the right to limit certain features or accounts based on age. Individuals under the age of majority (typically 18) may be restricted from certain uses of the Service (such as entering into transactions) in accordance with our Terms of Service and applicable law.
International Data Transfers and Export Compliance
Polarity primarily operates in the United States, but our Services may be accessible worldwide. As such, personal information that we collect may be transferred to or accessible by individuals and systems around the globe, including in countries that might not provide the same level of data protection as your home country. We have outlined above how we handle international data storage and transfers (see Where We Store Your Data).
If you are using our Services from outside the United States, you should be aware that any Personal Data you provide will be transferred to and processed in the U.S. (and potentially other countries) as needed to provide the Service and as described in this Policy. By using the Services or submitting your information, you consent to such international transfers. We will take steps to ensure appropriate safeguards when transferring personal data across borders, as required by relevant data protection laws. For example, if we transfer data from the European Economic Area (EEA) or United Kingdom to the U.S., we may rely on mechanisms such as Standard Contractual Clauses or an adequacy decision, where applicable, to legitimize the transfer.
Additionally, the use of our Services is subject to U.S. export control and economic sanctions laws. Export Compliance: Any software or technology we make available through the Services (including our mobile app) may be subject to United States export controls. You agree to comply with all applicable export and re-export control laws and regulations. In particular, you must not use, export, or re-export any part of the Services or any software provided by Polarity: (a) into any embargoed or sanction-designated country, or to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Commerce Department’s Denied Persons/Entities List; (b) to any country or entity if such export or use is otherwise in violation of any U.S. or applicable foreign law. By using the Services, you represent and warrant that you are not located in, under the control of, and are not a national or resident of any country or region that is subject to U.S. trade sanctions (including, for example, Cuba, Iran, North Korea, Syria, or the Crimea region) and that you are not on any government list of prohibited or restricted parties. If you access the Services from outside the U.S., you do so on your own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
License Plate Recognition (LPR) Data
Polarity integrates with License Plate Recognition (LPR) technology to support certain parking enforcement and access control features. LPR systems involve the use of one or more cameras (which may be fixed in place or mounted on patrol vehicles) combined with computer algorithms to read license plate numbers from vehicles and convert those images into computer-readable text data. The data collected by an LPR system – which typically includes the license plate number, an image of the vehicle (or plate), the date/time of capture, and the GPS location of the camera – is referred to in this Policy as “LPR Data.”
How We Use LPR Data: We use LPR Data to help provide and enhance our parking enforcement Services, to promote safety, and to prevent fraud or unauthorized parking. For example, at properties that use LPR cameras, the system can automatically detect a vehicle’s plate as it enters or parks, and cross-reference it with our database of authorized permits or paid sessions. If the plate is recognized as belonging to a valid permit holder, the system may log the parking session without the need for a physical permit. If a plate is not recognized (e.g., no active permit or payment), the system may flag the vehicle for review by property management or trigger a notification for enforcement. We will only collect or use LPR Data in locations and for customers that have implemented our LPR features as part of the Services – if a particular property or parking facility does not use LPR, then no LPR Data will be collected there. Similarly, if you do not park in a facility with LPR or otherwise interact with an LPR-enabled service, Polarity will not be collecting LPR Data about your vehicle.
Access and Sharing of LPR Data: Polarity partners with third-party providers who install and maintain the LPR camera hardware at parking facilities, and we integrate their feeds into our system. The LPR Data captured at a property is typically accessible to the property owner/manager and their authorized parking enforcement personnel through our dashboard (since it is their facility). Polarity’s own technical and support teams may also access LPR Data under certain circumstances – for instance, to troubleshoot a system issue, to maintain the LPR integration, or to assist a customer query related to a specific parking event. In addition, Polarity’s legal and security officers might access LPR Data if necessary for safety, compliance, or investigative purposes (for example, examining logs after a reported incident). All persons with authorized access to LPR Data are required to undergo training and to adhere to strict confidentiality and privacy rules, ensuring that they only use LPR Data in compliance with applicable privacy and security laws. We have implemented technical controls to log and periodically audit access to LPR Data, in order to ensure it is only accessed for legitimate purposes.
Polarity has taken reasonable steps to safeguard the information technology systems used in the operation of LPR services. This includes measures to prevent unauthorized electronic access, such as encryption of LPR Data in transit, secure networks for data transmission, and software protections against malware or “disabling code” that could compromise the cameras or data. We also conduct periodic checks of our LPR systems and access records to monitor for compliance with legal and security requirements.
Sharing of LPR Data: Polarity will not sell LPR Data and will only share LPR Data with third parties under very limited circumstances, such as:
- With our service providers who assist in providing the LPR Services (for example, the vendor that supplies the camera equipment or the cloud storage provider for LPR images). These providers are contractually bound to process LPR Data only as necessary to deliver their services to us and are not permitted to use it for their own purposes.
- With the parking facilities or property managers that use our Services and on whose behalf the LPR Data is collected. Essentially, the LPR Data belongs to the property where it was collected; we share it with the authorized personnel of that property so they can manage parking and enforcement.
- For the safety and security of our customers and communities. For instance, if a vehicle is suspected in a crime or if there is an immediate threat, LPR Data might be shared with law enforcement to assist in an investigation, as allowed by law and relevant agreements.
- For protecting the rights of our users and Polarity. We might use or share LPR Data to defend against legal claims or to enforce parking compliance in a way that protects permit holders (for example, proving that a vehicle was parked without permission if it’s blocking a reserved spot).
- Legal Requirements: To comply with laws or regulations, or in response to valid legal process (such as a warrant or subpoena), we may disclose LPR Data to law enforcement or other authorities. We will ensure any such sharing is done in accordance with applicable law governing LPR data (for instance, some jurisdictions require a warrant for law enforcement access to LPR records).
Outside of the above circumstances, LPR Data will not be shared with third parties. In particular, Polarity does not use LPR Data for marketing or advertising, and we do not share it with any third-party advertisers or data brokers. LPR Data is treated as highly confidential and is segregated within our systems.
User Access to LPR Data: In certain regions, you have rights regarding LPR Data that may have been collected about your vehicle. For example, California law grants individuals the right to request information about any LPR Data collected by an LPR operator in connection with their vehicle and to request correction of any inaccuracies. If you would like to know whether we possess any LPR Data about your vehicle (for example, your license plate appears in our system) or you believe that any LPR Data is incorrect, you may contact us to make an inquiry or request. We will take reasonable steps to verify your identity (for instance, we may ask for proof of ownership of the plate in question) and, upon verification, will search our records and inform you of the presence of any LPR Data related to your license plate. If any such data is found and you identify an inaccuracy, we will either correct the data or, if appropriate, provide you with information to help you get it corrected (for example, if the data is controlled by a property client, we may direct you to that entity). We aim to be transparent and compliant with all laws regulating LPR usage. Any requests concerning LPR Data can be sent to our contact information below, and we will respond as required by applicable law.
Changes to this Privacy Policy
We may update or modify this Privacy Policy from time to time to reflect changes in our business, changes in technology, legal updates, or for other operational reasons. Polarity reserves the right to change this Policy at our discretion and at any time. When we make changes, we will post the updated Privacy Policy on our website and update the effective date (and version) at the top of the Policy. The most current version of the Policy will govern our use of your information. We encourage you to review this Policy periodically to stay informed about our privacy practices.
If we make any material changes to this Policy (for example, if we start collecting additional categories of personal data or change how we share information), we will provide a more prominent notice of the change. This may include a notice on our website’s homepage, an in-app alert, or a direct notification via email or text message. In certain cases, if required by law, we may also seek your consent to the changes. For example, if a change would retroactively apply to data we collected under a prior policy, we might ask for your consent to the new uses.
Your continued use of the Services after any changes to this Privacy Policy have become effective will constitute your acceptance of those changes. If you do not agree with a change, you should stop using the Services and contact us if you wish to have your data removed. For your reference, we will maintain an archive or summary of previous versions of this Privacy Policy upon request so that you can see how our practices have evolved. This Policy Version supersedes all previous versions of our privacy policy as of the Effective Date above.
